Terms of service
Last updated: 16 October 2026 · Version 1.2
Welcome to HashKeep. These terms form a binding agreement between you and Icemint LLC, a Wyoming limited liability company operating under the Icemint Labs name ("Icemint", "we", "us"), governing your use of the HashKeep application and the hashkeep.app website (together, the "Service"). By installing or using HashKeep, you agree to them. If you do not agree, do not use the app.
1. Acceptance of these terms
By downloading, installing, or using HashKeep, you confirm that you have read and accept these terms and our Privacy policy. If you are using HashKeep on behalf of an organization, you represent that you have authority to bind that organization.
2. The service
HashKeep is an Android app that archives SMS in an encrypted local database, supports search and export, and optionally uploads encrypted backup files to your Google Drive. Restore adds records to HashKeep’s archive, not the system SMS inbox. Optional Delivery sends readable copies of backed-up messages through SMTP email, Telegram or Discord destinations you configure and test. These providers and recipients can read the copies; they are not encrypted backup files. HashKeep does not send carrier SMS and does not request SEND_SMS. Generic HTTPS webhooks are not supported.
3. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and capable of forming a binding contract to use HashKeep. The app is intended for use on Android 9 (API 28) and above.
4. Your license to use HashKeep
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use HashKeep on devices you own or control, in accordance with these terms and the Google Play terms. You may not reverse-engineer, decompile, resell, or sublicense the app, except to the extent that such restriction is prohibited by applicable law. The .hkv backup format is openly documented; you are free to write your own decoder for your own data.
5. Acceptable use
You agree to use HashKeep only for lawful purposes and only to back up messages you have a legal right to retain. You are responsible for complying with any laws that apply to the storage and retention of communications in your jurisdiction, including consent and record-keeping obligations. You must not use HashKeep to retain or access messages you are not authorized to access.
6. Your data & responsibility
You retain rights to your messages and data. Safeguard your device, passphrase and backups. New-phone recovery requires a portable backup created with a passphrase and that passphrase. Device-bound local files and scheduled backups require the original device key. Portable local files are available in Internal Testing from version 0.2.0; older device-bound files do not become portable. We cannot recover your passphrase or escrow your keys. A portable backup may also remain recoverable on its original installation through the device key; this does not provide new-phone recovery if you lose the passphrase. Only configure Delivery to destinations you are authorized to use, and protect readable exports and delivered copies. Disabling Delivery does not recall copies already sent.
7. Payment, Pro, and refunds
HashKeep's core features are free. HashKeep Pro is a one-time in-app purchase at the localized price shown by Google Play before purchase that unlocks additional features for the lifetime of the product, with no subscription and no recurring charge. The purchase is processed by Google Play Billing; Google is the merchant of record and the transaction is subject to Google's terms. Refunds are handled in accordance with Google Play's refund policy, together with any non-waivable consumer rights you have where you live.
8. Availability & updates
We aim to keep HashKeep working and updated, but we do not guarantee uninterrupted availability. Android device manufacturers may restrict background apps in ways outside our control; we provide guidance in-app to mitigate this. We may release updates that add, change, or remove features.
9. Disclaimer of warranties
HashKeep is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be error-free, that backups will be uninterrupted, or that it will capture every message in every device and carrier configuration. Nothing in these terms excludes liability or limits any right that cannot be excluded or limited under applicable law.
10. Limitation of liability
To the maximum extent permitted by law, Icemint will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data or messages, arising from your use of (or inability to use) HashKeep. Where liability cannot be excluded, our total liability is limited to the amount you paid for the app in the 12 months preceding the claim. Your non-waivable statutory consumer rights are unaffected.
11. Dispute resolution
Please read this section carefully. It affects how disputes between you and Icemint are resolved, requires individual arbitration for most disputes, and waives class actions.
11.1 Application of this section
This Section governs any dispute, claim, or controversy arising under or relating to these terms, the Service, or any related communications or interactions between you and Icemint (each, a "Dispute"), regardless of whether the Dispute sounds in contract, tort, statute, or any other legal theory. "Claimant" means the party asserting a Dispute; "Respondent" means the party against whom it is asserted.
11.2 Pre-dispute notice requirements
Before initiating any formal dispute-resolution process under this Section, Claimant shall send Respondent a detailed written notice of the Dispute by email to hello@hashkeep.app with delivery confirmation, or by mail to Icemint LLC, 30 N Gould St Ste R, Sheridan, WY 82801, USA. The notice shall include all of the following:
(a) Claimant's full legal name and current postal address;
(b) any email address Claimant has used in connection with the Service;
(c) the specific date or dates of the events forming the basis of the Dispute;
(d) a specific description of the conduct alleged and the harm alleged;
(e) the legal theory or theories on which the Dispute is based;
(f) a factual basis for Claimant's standing to bring the Dispute;
(g) the nature of Claimant's fee arrangement with counsel, if any — including whether the representation is on a contingency, fee-sharing, referral, or hourly basis, the applicable rate or percentage, and the identity of any third party funding the Dispute; and
(h) a list of all claims, demands, or arbitration proceedings filed by Claimant within the 24 months preceding the notice that assert substantively similar legal theories or arise from substantively similar conduct, including the names of respondents and the disposition of each.
A notice that omits any of the foregoing is procedurally deficient, and the timelines under this Section do not begin until a compliant notice is received. The disclosures in subparts (g) and (h) are intended to enable a good-faith assessment of the Dispute and to allow any arbitrator to screen for fraud, abuse, or improper purpose. They are screening disclosures only and do not, by themselves, determine the outcome of any Dispute.
11.3 Informal resolution period
Within 60 days of Respondent's receipt of a compliant notice, the parties shall engage in good-faith informal resolution, including not fewer than two principal-level discussions. Respondent will offer a reasonable slate of dates within the period, and Claimant will select from them. Meetings may be conducted by video conference, and Claimant may be accompanied by counsel or an authorized representative; no travel is required. Failure to participate in good faith is a material procedural defect, and no arbitration may be commenced until this requirement is satisfied or expressly waived in writing by Respondent.
11.4 Binding arbitration
Any Dispute not resolved through Sections 11.2 and 11.3 shall be resolved exclusively by binding arbitration administered by the American Arbitration Association ("AAA") under its then-current Consumer Arbitration Rules. The arbitration shall be conducted by a single arbitrator. The seat and any in-person component of the arbitration shall be in Sheridan, Wyoming; however, either party may elect to have proceedings conducted by video conference, and the arbitrator may not require a consumer to travel to attend. Filings with any other arbitration provider are procedurally deficient and do not commence the arbitration.
11.5 Costs and fees
Each party shall bear its own attorneys' fees and costs, except as otherwise required by applicable law or the rules of the arbitration provider. The allocation of arbitration fees shall comply with the consumer-protection floors imposed by the AAA Consumer Arbitration Rules, which cap the consumer's share of fees regardless of any contrary language in these terms.
11.6 Class-action waiver
Each party may bring claims against the other only in that party's individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative action. The arbitrator may not consolidate more than one party's claims and may not preside over any representative or class proceeding. If any portion of this class-action waiver is found unenforceable as to a particular Dispute, that Dispute shall proceed in a court of competent jurisdiction (subject to Section 11.9), and the arbitration agreement in Sections 11.4 through 11.5 shall be null and void as to that Dispute only. This class-action waiver is non-severable from the arbitration agreement; the waiver may not be severed and the arbitration continued as a class proceeding.
11.7 Carve-outs from arbitration
Notwithstanding the foregoing, either party may: (a) bring an individual claim in small-claims court if it qualifies; (b) seek injunctive or other equitable relief in a court of competent jurisdiction to prevent infringement, misappropriation, or unauthorized use of intellectual property; (c) pursue collection of undisputed amounts due; and (d) bring any claim that, as a matter of law, may not be subject to pre-dispute arbitration. The pendency of any such action does not affect the parties' obligations under Sections 11.2 through 11.6 as to any other Dispute.
11.8 Survival
The obligations of Sections 11.2 through 11.7 survive termination of these terms.
11.9 Governing law and venue
These terms and any Dispute are governed by the substantive laws of the State of Wyoming, USA, without regard to its conflict-of-laws principles, and by applicable U.S. federal law (including the Federal Arbitration Act). Any Dispute not subject to arbitration, or that escapes the arbitration agreement for any reason, shall be brought exclusively in the state or federal courts located in or nearest to Sheridan, Wyoming. Each party consents to the personal jurisdiction and venue of those courts. Nothing in this Section deprives you of the protection of any mandatory consumer-protection law of your country or state of residence that cannot be waived by agreement.
11.10 Severability
If any provision of this Section is held unenforceable, it shall be severed and the remaining provisions shall remain in full force, except that the class-action waiver in Section 11.6 is non-severable from the arbitration agreement as set out there. Where a provision is unenforceable in part, it shall be enforced to the maximum extent permitted by applicable law.
12. Termination
You may stop using HashKeep at any time by uninstalling it. We may suspend or terminate your license if you materially breach these terms. On termination, the license ends, but data already on your device or in your Drive remains yours and under your control.
13. Changes to these terms
We may update these terms from time to time. Material changes will be announced in-app and reflected in the "last updated" date and version above. Continued use after a change takes effect constitutes acceptance.
